Where the claim comes from
Two sources feed the claim. The older is the United States' prohibition on Kinder Surprise eggs, which contain a toy inside the chocolate; Kinder Joy was designed to comply with that law and is sold in the US. The newer is FSSAI's June 2026 notice to Ferrero over the 'rich in milk solids' claim, reported during the regulator's crackdown on misleading claims.
Kinder Joy is on sale in India and is not the subject of any prohibition. In June 2026 FSSAI issued Ferrero a notice disputing the claim on the packaging that the product is 'rich in milk solids', one of dozens of claim-based notices the regulator issued that summer. The notice asks the company to substantiate or remove the wording; it does not restrict sale.
The longer-running confusion is American. Kinder Surprise, the original hollow chocolate egg with a toy capsule inside, is prohibited in the United States under a rule against non-nutritive objects embedded in confectionery. Kinder Joy, which separates the toy from the edible half in a two-compartment shell, was created to comply with that rule and is sold legally in the US. Indian posts asking whether Kinder Joy is 'banned abroad' or 'banned in India' typically conflate the two products.
No recall, prohibition or licence action against Ferrero India is on record.
