Energy Drink Ban in India 2026: State-by-State Guide

First, the national position

Red Bull, Monster, Sting, Campa Energy, Hell and Adrenaline Rush are legal to make, sell and drink everywhere in India except where a state has said otherwise. There is no national ban, no product recall and no finding that any of them is unsafe. What changed in 2026 is the name on the can and the claims around it.

The standard: regulation 2.10.6

India has had a standard for these drinks for years. Under regulation 2.10.6 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, a non-alcoholic drink with more than 145 mg of caffeine per litre is a "Caffeinated Beverage". Caffeine from all sources is capped at 300 mg per litre. A 250 ml can at the cap holds 75 mg, roughly a cup of filter coffee. Vitamins B1, B2, B3, B6 and B12 may be added up to one recommended daily allowance per serving, and taurine and inositol within set limits.

The label must carry a prominent "High caffeine" declaration with the quantity, the statement "Consume not more than 500 ml per day", and the warning "Not recommended for children, pregnant and lactating women, persons sensitive to caffeine". Those words have been required for a long time. The 2026 dispute is about the words around them.

The 2026 FSSAI order

On 1 July 2026 FSSAI issued notices to six brands: Red Bull Energy Drink, PepsiCo's Sting and Adrenaline Rush, Reliance's Campa Energy Drink Gold Boost, Coca-Cola-backed Monster Energy and Hell Energy. Its position was that it has "not notified any standard for 'energy drink'", so calling a product one, and making claims such as "vitalises body and mind" or "boost energy levels", misbrands it under the Advertising and Claims Regulations. The companies were given 90 days to remove "energy drink" and any similar descriptor from packs, advertising and online listings and to use the regulatory name, "Caffeinated beverage". Counting from the 3 July 2026 direction, the deadline falls on 29 September 2026 (being verified)

The Indian Beverage Association asked for risk-based enforcement and consultation. Companies said 90 days was tight for reprinting packaging. None of this stops sale. A can bought after the deadline should read "Caffeinated beverage" and carry the caffeine figure and warnings; older cans may linger in trade.

Rajasthan: statewide stop on sale and storage (July 2026)

Rajasthan is the one state that has gone beyond labels. In the week to 10 July 2026 the Food Safety and Drug Controller's Commissionerate, under a campaign called "Shuddh Aahar, Milawat Par Waar", seized more than five lakh cans and bottles across the state and then ordered a complete stop to sale and storage, extending it to online platforms. The Joint Commissioner, Vijay Prakash Sharma, said labels carrying "Energy Drink, Vitalizes Body and Mind" made claims without scientific backing, in breach of FSSAI's rules on misleading claims. Reports on 13 July 2026 named the Commissioner, Dr T Shubamangala, and described the restriction as covering sale, storage and display.

Jaipur saw the largest seizures: 53,256 Red Bull cans from a warehouse of M/s Adarsh Associate and more than 1.8 lakh Hell cans from a second premises. Brands named in the reports are Red Bull, Sting, Adrenaline Rush, Campa Energy Gold Boost, Monster and Hell; some reports list eight brands, and one version includes a juice brand that looks like an error (being verified) Because Jaipur is in Rajasthan, "is Red Bull banned in Jaipur" has the same answer as for the state: sale is stopped while the order stands. Whether any brand has challenged it in the Rajasthan High Court is not recorded in the sources we could reach (being verified)

Legally, a state Commissioner of Food Safety can prohibit sale of a food in the state for up to one year under section 30(2)(a) of the Food Safety and Standards Act; the Rajasthan order's exact section and date are to be confirmed (being verified)

Maharashtra: no sales within 500 metres of schools (announced July 2026)

On 3 July 2026 Maharashtra's Food and Drug Administration minister, Narhari Zirwal, told the legislature that sale of high-caffeine energy drinks would be banned within 500 metres of schools, and directed the FDA to enforce it, alongside new testing labs and school awareness drives. Reports named Sting, Red Bull, Adrenaline Rush, Campa Gold Boost, Hell and Monster as the products in view, but the restriction as announced applies to the category, not to a list. We have not seen the FDA's written order or its date of effect (being verified) Outside the 500 metre zone, sale in Maharashtra is unaffected.

Punjab: no sales to minors near schools (since April 2025, renewed 2026)

Punjab acted first. On 25 April 2025 the state Food and Drugs Administration, under Commissioner Dilraj Singh, barred sale of energy drinks to minors in school canteens, tuck shops and shops within 100 metres of schools in rural areas and 50 metres in urban areas, for one year, citing the labels' own "not recommended for children" warning. A fresh one-year order was reported on 21 April 2026 under Commissioner Kanwal Preet Brar, and on 30 April 2026 Ludhiana's health department reiterated it with checking drives around schools. Adults can buy the drinks anywhere in Punjab; the restriction is about children and school surroundings.

Gujarat and everywhere else

We searched for a Gujarat order and found none. Gujarat news coverage in 2026 reports the national FSSAI relabelling order, not a state action. If you have seen a claim that Gujarat, Karnataka, Tamil Nadu, Delhi or any other state has banned energy drinks, treat it as unverified unless it names the order. How to read a "ban" headline

Ask three questions. Which authority: FSSAI, or a state commissioner? What is restricted: the word on the label, sale near schools, sale to minors, or all sale? Where: nationally, or in one state? On today's evidence the answers are: FSSAI restricts the label nationally; Rajasthan restricts all sale in Rajasthan; Maharashtra and Punjab restrict sale around schools. That is the whole list.
