Supplement or drug: where does FSSAI's authority end?
Last checked 10 October 2026
Under FSSAI's 2022 regulations a health supplement 'shall not include a drug' (regulation 3(4)) and may not contain hormones, steroids, psychotropic or NDPS substances (regulation 3(5)); a Nov 2024 inter-ministerial proposal to move complex products to CDSCO is only a proposal.

Below: Blacklisted's explanationWe organise and explain what the document says. The document above is the authority.

Where the claim comes from
Many 'is it banned' questions about supplements turn on one question: is the product a food supplement or a drug. FSSAI's regulations answer it in regulation 3(4) and 3(5).
Most 'is it banned' questions about supplements come down to one: is the product a food supplement or a drug? FSSAI's health supplement and nutraceutical regulations of 2022 answer it. Regulation 3(4) says these products shall not include a drug as defined in section 3 of the Drugs and Cosmetics Act. Regulation 3(5) says they may not contain hormones, steroids, psychotropic or NDPS substances, or items in Schedule E and E1 of the Drugs and Cosmetics Rules. The label must say 'NOT FOR MEDICINAL USE'.
Inside the line, the schedules list the permitted ingredients and their daily limits: for example melatonin at 2 to 10 mg, creatine at 3 g for adults, caffeine at 3 mg per kg of body weight, and ashwagandha root at 3 to 6 g. Outside it, a product is a drug question and belongs under the Drugs and Cosmetics Act and CDSCO.
The rules themselves are in an unusual position. FSSAI put them into operation by a direction of 30 Mar 2022 and re-operationalised them from 1 Apr 2023. We found no final gazette notification in 2025 or 2026. In Nov 2024 an inter-ministerial committee proposed that simple vitamins and minerals stay with FSSAI, complex formulations and disease-risk-reduction claims move to CDSCO, and botanicals with such claims go to AYUSH. That is a proposal, not law.
What this means for you
The line is the drug
If a product is a drug, or contains one, it is outside the supplement rules. That is why SARMs, steroids, sibutramine and unapproved prescription drugs cannot be sold as supplements.
Check the permitted list
A supplement may use only what FSSAI's schedules permit, with the daily limits listed there. An ingredient that is absent from them is not permitted.
A proposal is not a rule
The Nov 2024 recommendations would change who regulates complex products. Until they are adopted, FSSAI's 2022 regulations are the working rules.
This is a record of official orders, not medical advice. Do not stop a prescribed medicine without asking your doctor or pharmacist.
Common questions
What does 'NOT FOR MEDICINAL USE' mean on a supplement label?
The 2022 regulations require this label on health supplements and nutraceuticals, because they are not drugs.
Will CDSCO take over supplements?
An inter-ministerial committee proposed in Nov 2024 that complex formulations and disease-risk-reduction claims move to CDSCO. It is still a proposal.
